Eligibility
You must be at least 18 years of age or accessing the platform under the direct supervision of a parent or legal guardian to create an account and place an order. By using our application, you represent and warrant that you possess the legal authority to enter into these binding terms.
Account and User Information
To use our real-time ordering and delivery features, you are required to create an account by verifying your email via OTP. You agree to provide accurate, current, and complete information, including your name, active phone number, and correct delivery address. You bear full responsibility for any delays or delivery failures caused by incorrect information entered into your profile.
Ordering Process
Orders are placed exclusively through our application. Upon confirmation of an order, we immediately begin the scheduling and preparation processes to ensure freshness. It is your responsibility to review your order details, including flavor, size, and custom specifications, before confirming the final payout.
Pricing and Payments
All prices listed on the app are clearly indicated and are subject to nominal taxes as applicable by law. Payments are processed securely via our trusted payment gateway partner, Razorpay. We may also offer Cash on Delivery based on your specific location and order profile. We never collect or store your sensitive card or banking details directly.
Delivery Terms
We strive to deliver your fresh cakes right to your specified location within the communicated timeframe. However, because deliveries are facilitated through third-party partners, occasional delays may occur due to external factors such as traffic, weather, or unforeseeable logistics disruptions. We coordinate closely to minimize these events but ask for your understanding in extreme cases.
Cancellation
We respect your plans might change, but due to the fresh and made-to-order nature of our cakes, orders can be cancelled only before preparation has started. Once the kitchen begins crafting your cake, the order is locked and cancellation requests will not be accommodated under any circumstances.
Refund Summary
Refunds are rarely required but are strictly governed by our specific policy. We issue refunds solely in cases where the entirely wrong product was delivered, the product arrived significantly damaged, or the order completely failed to deliver. Perishable Nature of Cakes
Cakes are highly perishable goods that require immediate care and proper refrigeration upon delivery. Because of their delicate nature, all cakes are non-returnable once safely handed over at your delivery address. We cannot be held liable for damage occurring to the product after a successful and accepted delivery.
User Responsibilities
You agree to utilize the Mr.Cakewala app respectfully and legally. You must not exploit bugs in the ordering system, provide fraudulent payment information, or submit inappropriate or offensive content for custom photo cakes. We reserve the right to suspend or terminate accounts that display abusive behavior towards our delivery partners or staff.
Custom and Photo Cakes
If your order includes a custom printed photo cake, you must own the rights or possess necessary permissions to print the imagery you upload. Your transferred image remains your property and is maintained securely by us sole for the purpose of fulfilling your custom order. We will never publish your personal images for marketing without explicitly asking for and receiving your prior written consent.
Intellectual Property
All official branding, text, graphics, logos, and software utilized in the application are the exclusive intellectual property of Mr.Cakewala. Unauthorized reproduction, modification, or distribution of our proprietary UI and brand elements without explicit authorization is strictly prohibited.
Advertisements
Our app does not display third-party advertisements. You will only encounter internal promotions, seasonal offers, and direct marketing specific to Mr.Cakewala products. This ensures a clean, distraction-free ordering interface.
Limitation of Liability
While we guarantee uncompromising quality in our baking, Mr.Cakewala shall not be liable for indirect, incidental, or consequential damages resulting from the use or inability to use our services. Our maximum liability for any proven claim directly related to an order shall never exceed the total amount paid by you for that specific order.
Modifications to Terms
We maintain the right to revise or update these Terms & Conditions from time to time. Continued use of the Mr.Cakewala service implies acceptance of the updated terms. It is your responsibility to monitor this page for any significant alterations regarding your rights.
Governing Law and Jurisdiction
These terms and all operational transactions are governed exclusively by the laws of India. Any legal disputes arising in connection with the Mr.Cakewala services shall be subject strictly to the jurisdiction of the competent courts in Hyderabad.
